De Bellisens 42, office 129, CP 43204 – Reus (Tarragona). The use and/or contracting by the user of the services contained on the website HotelAdariaVera.com implies the express and unreserved acceptance of each and every one of the provisions contained in these General Contracting Conditions, as well as the acceptance of each and every one of the specific policies and conditions of the different service providers that facilitate the contracted services:

Definitions and scope

The terms of these General Contracting Conditions shall be understood in accordance with the following definitions:

• Hoteladariavera.com: Web portal dedicated to the booking of tourist accommodation.
- Client: The term "client" shall be understood as the person who books one or more services offered on the "Hoteladariavera.com" website.
- Services: The term "service" refers to any service offered by “Hoteladariavera.com” on its website, such as the booking of accommodation and other complementary or leisure services.
- Website: Refers to the website Hoteladariavera.com
- Supplier or service provider: Refers to the service providers that ultimately provide - either by themselves or through third parties - the services contracted by the client. These shall include, among others: hotels, ski resorts, insurance agencies, and other providers of complementary services.

HotelAdariaVera.com is authorized to modify these General Contracting Conditions at any time and without prior notice; however, these changes will not affect bookings that HotelAdariaVera.com has accepted prior to the modification. For this reason, the client is recommended to read, save, and print a copy of these General Contracting Conditions when finalizing their booking.

Legal capacity to contract

The user declares that they are of legal age (over 18 years old) and have the necessary legal capacity to contract the services offered by HotelAdariaVera.com, stating that they accept the binding nature of this agreement and fully understand and accept the conditions announced herein for the use of the website and the services offered. In the case of contracting by minors, authorization from parents or legal guardians will be required to proceed with the booking of the services offered. HotelAdariaVera.com is not responsible for the truthfulness and accuracy of the data filled in by the user and, therefore, cannot verify their age. Consequently, HotelAdariaVera.com is not responsible for any negative effects that may arise for the client in the event of omission, misrepresentation, or concealment of data.

Knowledge and express acceptance of the conditions

The use of the HotelAdariaVera.com website as well as the contracting of any service offered by HotelAdariaVera.com implies the knowledge and express acceptance of these General Contracting Conditions. Likewise, the contracting of a service on the HotelAdariaVera.com website implies the explicit and unreserved acceptance of the specific contracting conditions of each product or service offered, as well as the contracting policies of the service provider in charge of offering and/or executing the contracted service. The contracting of any service implies the express acceptance of the policies and specific conditions established by each service provider. In particular, the client agrees to be bound by the internal rules and protocols established by each service provider, especially regarding rules of conduct, right of admission, hygiene, safety, and good coexistence among guests and/or users. In the event of a conflict, discordance, or inconsistency between these General Conditions and the Special Terms and Conditions of each offer, the latter shall prevail.

Formalization of bookings

• Procedure: When the user makes their booking through the HotelAdariaVera.com website, the booking will not be confirmed until the payment or full deposit of the contracted services is made. In the event that payment for the services is not made at the time of formalizing the booking, HotelAdariaVera.com reserves the right to cancel the client's booking. Requesting a booking on the HotelAdariaVera.com website implies the client's acceptance of the charge for the amount of the contracted booking via the payment method selected by the client. In the event that the client decides to pay for their booking by bank transfer or deposit, HotelAdariaVera.com reserves the right to suspend the processing and confirmation of the booking until it can verify that the transferred amount has effectively been deposited into the bank account owned by HotelAdariaVera.com. In the event that the amount for the contracted services is not paid in full and effectively to HotelAdariaVera.com according to what is stipulated in each selected offer, HotelAdariaVera.com may cancel and annul the booking, and the client must assume the costs that such cancellation may entail.
- Communications with the client: The client expressly accepts that communications from HotelAdariaVera.com be carried out via the email address provided by the client themselves. In the event of detecting any incident related to a client's booking, HotelAdariaVera.com will contact the client via the email address indicated by the latter. In the event of being unable to contact the client via the aforementioned means, HotelAdariaVera.com will attempt to contact the client by telephone. However, if the telephone route is unsuccessful, the client expressly accepts being considered notified of any eventuality by the sending, by HotelAdariaVera.com, of an email informing them of such circumstance.

Truthfulness of data, proof of identity, and privacy policy

To contract the different services offered by HotelAdariaVera.com on its website, the user declares that all information provided at the time of making their booking is truthful, complete, and accurate. The client who formalizes a booking expressly authorizes HotelAdariaVera.com to include the personal data appearing in the form fields in an automated private file for the proper provision of its services. The booking holder must enter the data correctly as it appears on their National ID card or passport. The booking is assigned to a single holder; therefore, the data indicated in the 'Holder' field must correspond entirely to the client who is the holder of the booking, and not to the data of other travelers. HotelAdariaVera.com is not responsible for problems that the omission or falsification of data might generate. The client is responsible for providing information regarding their booking truthfully, taking into account that all data included in the booking must remain valid at the start of the trip or the commencement of the contracted service provision. If applicable, the client must take special care in determining the age of any minors included in their booking, as it must be considered as of the trip's start date and not at the time of formalizing the booking. The client is obliged to arrive for the contracted service provision equipped with the legal documents that duly prove their identity and that of all members of the booking. HotelAdariaVera.com is under no circumstances responsible for the failure to present the required documentation and the consequences that this may entail. In accordance with the provisions of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, as well as Organic Law 15/1999, of 13 December, on the Protection of Personal Data, we inform you that your data will be included in an automated file protected with the necessary technical measures to prevent its alteration or loss. It is stated that the data controller is the commercial company ACTIVOS TURISTICOS VERA, S.L. and that the client may exercise their rights of access, rectification, opposition (suppression), limitation and/or modification, as well as portability, by sending an email to: legal@petitshotels.es or by postal mail addressed to the aforementioned registered office. The data provided by the client will be processed in accordance with the provisions of our Privacy Policy.

Communication and transfer of data to third parties

Data will only be transferred in the cases provided for in the Data Privacy Policy.

Cancellation and modification policy

HotelAdariaVera.com strives to establish a clear and understandable modification and cancellation policy so that the client can know exactly the consequences of any potential modification and/or cancellation of their booking. Despite the fact that the right of withdrawal does not apply to the acquisition of accommodation services other than those intended as a dwelling, in accordance with the provisions of Article 103 of the Law for the Protection of Consumers and Users, the client will have the right to modify and/or cancel their booking, with both rights being subject to the provisions of these General Contracting Conditions and those established in the Specific Conditions of each offer. Bookings made with special and/or non-refundable rates cannot be modified by the client unless otherwise expressed in the published offer. The modifications that the client intends to make may entail modification costs of up to 100% of the amount paid.

• Cancellation of bookings: The client may withdraw from the contract and cancel their booking by using the contact section enabled on the HotelAdariaVera.com website, having to face the cancellation costs of the service specified for each offer, which will be shown to the client during the booking process.
- No-show of the client at the departure of the trip or at the accommodation: In the event that the client does not arrive at the accommodation on the contracted arrival date, 100% of the booking amount will be charged. In the event that the client anticipates a delay in their arrival at the accommodation, they must notify HotelAdariaVera.com so that the pertinent arrangements can be made regarding the maintenance of their booking.
- Early departure from the accommodation or early withdrawal from the trip: In the event that the client decides to leave the contracted accommodation before the end of their booking, or to end the contracted trip before its conclusion, we inform you that this entails a cost of 100% of the booking amount.

Modification or cancellation by HotelAdariaVera.com

In the event of impossibility of providing the service, whether for reasons attributable to the service provider or for reasons attributable to HotelAdariaVera.com, for example, due to overbooking of the accommodation or its closure, due to impossibility of proper service provision, due to the imposition of restrictions dictated by the competent authorities, due to technical errors or service availability, among others, HotelAdariaVera.com reserves the right to offer the client accommodation of equal or higher category than the one they had contracted, provided that this is possible. If the consumer and user does not accept such a change, the contract will be terminated, and HotelAdariaVera.com will reimburse the amounts that the client had paid. In the event that HotelAdariaVera.com cannot offer the client a valid alternative to the contracted service, the booking will be cancelled, and the amounts paid by the client will be fully refunded.

Prices and Taxes

Unless stated otherwise, the prices shown in the offer visible to the client are the final prices per person and stay (VAT included) that the user must pay to HotelAdariaVera.com. The offers displayed on the website will indicate all items included in the booking; therefore, any other service not detailed in the offer shall be understood as not included and will not form part of the contract.

Client responsibilities

Without prejudice to other responsibilities established in these general contracting conditions and the Specific Conditions of each offer, the client is reminded that, to guarantee the correct development of the contracted service, they must take into account the following: a) Communicate any type of incident or breach of contract. With the aim of being able to solve any incident that occurs during the course of the contracted trip, HotelAdariaVera.com reminds the consumer or user that complaints, incidents, or claims that are formulated must be recorded at the destination itself (on-site) where the service provision takes place so that they can be resolved in the shortest possible time. b) Have the necessary and valid documentation for the development of the trip.

Proof of identity and possible fraud

In order to guarantee the correct development of the contracted bookings, HotelAdariaVera.com reserves the right to request its clients to send a photocopy of their national identity document or any other document that reliably proves their identity. In the event that the client or their companions do not provide the aforementioned information, HotelAdariaVera.com will be in a position to cancel the affected bookings, returning the amounts paid to the client. In the event that HotelAdariaVera.com perceives indications of possible fraud in the making of bookings, it will carry out whatever investigations it deems appropriate and reserves the right to cancel the affected bookings. The cancellations of the bookings referred to in the previous paragraphs will be communicated to the clients by sending an email and making a telephone call to the addresses and numbers that the client has provided to HotelAdariaVera.com. The company is not responsible for the non-observance that the client may have of the contact channels provided.

Use of the website and content

This website is intended solely and exclusively for the personal use of users. Its modification, reproduction, duplication, copying, distribution, sale, resale, and any other form of exploitation, whether for commercial purposes or not, is prohibited. The client agrees not to use this website for illegal or prohibited purposes. In particular, the user of the website accepts that they may only use the website for themselves and that the products or services acquired through the website will be intended for their own use or consumption or that of the persons on whose behalf they are legally authorized to act and contract. The user shall not resell the products or services acquired through the website to other persons.

Use of photographs and illustrations

HotelAdariaVera.com makes every effort so that the photographs and illustrations shown on its website correspond to reality and offer a visual representation of the services it markets. The purpose of including these images is to be able to offer the client a more detailed impression of the contracted services. However, these photographs should not be considered as an exact statement of the services but as a merely indicative parameter of them.

Accommodation services and their meal plans

• Accommodation plans: a) All-inclusive plan: Unless expressly indicated, the all-inclusive formula includes meals, non-alcoholic drinks, and the activities mentioned in the advertising campaign and/or in the description of each service provided by the tourist service provider. Likewise, as a general rule, the all-inclusive plan covers only local alcoholic beverages. b) Full-board plan: Includes breakfast, lunch, dinner, and accommodation. The general rule is that lunches and dinners do not include drinks unless otherwise indicated in the offer. c) Half-board plan: Unless otherwise indicated in the offer, it includes breakfast, dinner, and accommodation. The general rule is that lunches and dinners do not include drinks. d) Bed and breakfast plan: Includes breakfast and accommodation.
- Meals: If meals are part of the accommodation package and the client cannot or does not want to consume them for reasons attributable to them, no refund of the amounts related to said meals will be made.
- References to the capacity of rooms, studios, apartments, and the like: HotelAdariaVera.com informs you that the capacity of the accommodation published on our web portal must be understood as the specific number of people who can stay overnight in a specific room, apartment, studio, or similar. Therefore, when reference is made to a single, double, triple, quadruple, quintuple, or similar room/apartment/studio, it must be understood that said accommodation can hold one, two, three, four, or five people respectively. The inclusion of extra beds for the configuration of a certain room type is carried out, in accordance with the above, with the express consent of the clients. The distribution of rooms, apartments, studios, or similar is subject to the availability of the establishment in question. Thus, the capacity of the rooms can be completed with single beds, double beds, bunk beds, extra beds, sofa beds, or similar.

Management of complaints and statute of limitations for actions

For the management of complaints, the client must contact the customer service department by sending their complaints/claims through the contact section found on the HotelAdariaVera.com website. On the other hand, in accordance with the provisions of Directive 2013/11/EU of the European Parliament and of the Council, of 21 May 2013, on alternative dispute resolution for consumer disputes, we inform you that you can consult information on alternative dispute resolution systems by accessing: https://ec.europa.eu/consumers/odr/.

Jurisdiction

Any possible disputes that may arise from the interpretation and/or compliance with this contract shall be settled by the courts and tribunals of the consumer's domicile when they effectively have the status of a consumer. Otherwise, the competent courts shall be those of the registered office of the company ACTIVOS TURISTICOS VERA, S.L., which are indicated in the heading of these General Contracting Conditions. If any clause included in these general conditions is declared totally or partially null or ineffective, said impact shall not extend to the other clauses of the contract that are not considered null. Consequently, the contract shall remain in force, excluding the clauses affected by the nullity or ineffectiveness.
